  1. CREDITOR'S RIGHTS. The firm's creditors' rights practice includes both commercial (business to business) and retail (business to consumer) collections. The firm handles collections matters through trial usually on a contingent fee basis. Our aggressive approach includes evaluation of a case once it is placed to determine whether there are assets available to satisfy the claim and if so, how to secure those assets pending the outcome of the trial. The firm can also assist in enforcing existing judgments by identifying assets which might be used to satisfy the judgment and aggressively pursuing post-judgment remedies in the appropriate state court. If the debtor files bankruptcy, the firm can assist in preparing proofs of claim or filing adversary proceedings to determine the dischargability of the client's debt.

  2. MECHANIC'S LIENS. For clients in the construction or related fields, the firm can assist with the drafting, recording and enforcement of mechanic's liens. The mechanic's lien law provides a powerful and efficient remedy to clients supplying goods and labor for commercial and residential construction projects.

  3. CIVIL LITIGATION. In addition to creditors' rights litigation, the firm is able to assist its clients with the prosecution and defense of other civil litigation claims. Such claims might include insurance, real estate, negligence and personal injury.

  4. CONTRACT REVIEW/DRAFTING. Collections issues often arise due to the failure of the client to establish good credit terms with its customers. The firm can assist in drafting agreements or modifying the client's existing agreements with an eye toward avoiding collections issues and protecting the client's rights should collection action be necessary. Some essential terms that should be included in client contracts include: the recovery of attorneys' fees; interest; and personal guarantees of corporate debts. 

  5. TRANSACTIONAL WORK. The firm can assist client's in drafting and negotiating a wide range of agreements including contracts with the client's vendors, suppliers and customers; commercial leases; and purchase and sale agreements.

 

6. ENFORCEMENT OF FOREIGN JUDGMENTS.  The firm regularly handles collection of foreign (out of state) judgments.  Massachusetts does not have a judgment registration procedure so a new lawsuit must be commenced in Massachusetts.  Through aggressive litigation of foreign judgments, the firm can convert an out of state judgment to a Massachusetts judgment quickly and efficiently so that the Massachusetts judgment can be enforced.
